Re: final concern before closing

Please accept this as our written request for a copy of our appraisal for 3463 Maskoke Trail, Hartsel, CO 80449. We can either pick it up at your location or it can be mailed to us at P.O. Box 87, Hartsel CO 80449.

Karen and I have a few issues left to resolve with Grand West before final closing.

We recently found our copies of the agreement we signed with Grand West. Following your advice, we decided to "read the contract". Accordingly, we have some questions for you pertaining to your stated obligations under heading "Release Of Funds". Under "Other Draws", item 3 states, "Grand West Financial, Ltd, then requires an inspector to verify the work that the work has been completed." Based upon this clause in your contract, we feel you are the one to ask the following:

For draw #4, we would like to know what inspector was assigned to perform the verifications and in the process of this verification, what supporting documents were requested by the inspector. We want copies of these documents. We have issues with the monies submitted and the categories in which they were entered.

For draw #3, we have specific issues we want resolved: We have repeatedly requested from NorthStar, verification of why the carpeting cost ran over since we signed the draw sheet on November 22nd. We have not been given an answer.
The septic ran over. It was $4,200 over. We want to see the verification as to why it went over. There is an additional $100 charge on the foundation which puts the foundation 7% over. Why?
Home Delivery is shown on draw #2 and Draw #3. It is over by $500, or 38%. We want the reasons why. The verbal explanation that it was a fuel surcharge isn't sufficient.

It is our understanding that all overages in excess of 5% must be approved in writing. We want to see these approvals.

Additionally, I reference your earlier statements supporting NorthStar's claim that they were not obligated contractually to do any electrical work: I refer to the 3-page copy your office provided us. The contract we signed with NorthStar states that they will not supply any electrical power which is entirely different from doing electrical wiring. The hand-written change to page 2 was made after we signed the contract and therefore is not valid. In our many inquiries to contractors, electricians, and pump installers, the answer we received was unanimous: the wiring of the pump is the contractor's responsibility. If we are presented with a bill for this wiring, we will pay it under protest and then have the issue resolved later in court with both Grand West and NorthStar.
