In reference to your telephone call at 9:17PM Monday, January 8, we take issue with several points.

First, you submitted an invoice to Rocky Mountain dated October 15, 2000, in which you requested, and subsequently were paid for, the house. According to your own paperwork you have been paid for this house. That means the title belongs to Rocky Mountain, not NorthStar as you claim. Monica confirmed this in an earlier conversation we had with her.

Kevin gave us permission to move our belongings into the house once the temporary occupancy permit was issued. He stipulated, and we agreed, that we would not actually live in the house until closing. Additionally, Monica at Rocky Mountain, has also agreed to us moving our belongings in with the same conditions. We confirmed to Monica that we had in fact changed the locks to protect our personal belongings. She said that was all right with her as long as we were not living in the house.

As you may recall, we stated another reason for changing the locks was the fact someone had broken into the shed. At the time, we did not know it was your employee Troy. We first heard of this from Kevin and it was later confirmed by Sherry. We filed a criminal trespass complaint with the Park County Sheriff's Department shortly after finding out what had really happened. The complaint is on hold pending our decision whether or not to prosecute. That decision depends upon NorthStar's willingness to pay for the damage.

As for leaving messages at a reasonable time, perhaps you should first look towards you and your office.

Finally, we are putting you on notice, that no representative of NorthStar, their employees, or agents of any type, have permission to be on our property without our prior specific permission and our physical presence. Since we own the land and Rocky Mountain owns the house, this is enforceable.
