Dear Sir,

Last May, near the end of the month, my wife and I had an occasion to chat with you while you were running the CONOCO station, also in Florissant. I believe it was a Sunday. We were heading towards Colorado Springs from Fairplay and stopped for gas. We remarked to you that we were from Virginia and were in Colorado looking for model homes because we wanted to build a house on some land nearby and move to Colorado. You said something about that there were a lot of builders around from which to chose. I then commented that we were aware that there was one in Florissant, we had seen their advertising, but we didn't know where they were.

At this point you directed our attention to the other (the Total) gas station, telling us that there was a model home belonging to the builder in question (NorthStar) beside the gas station. You also stated that if we bought a home from those folks, we would receive a certificate good for $500.00 worth of purchases at the Total Gas Station, which you also owned. We took your advice and stopped to look at the model.

We liked the model. And, on the side of the model, was a large banner sign that said what you had, there was a $500.00 certificate for anyone purchasing a home from NorthStar. Neither you or the sign indicated anything about us, or any other buyer, having to go into the Total Gas Station and fill out a form to take with us to NorthStar before we inquired about buying a home. When we walked into the offices of NorthStar, my wife asked the sales person, Craig Davis, if the $500.00 offer was still good and he replied, "Yes".

Subsequently, we purchased a home from NorthStar. Despite my wife's repeated inquiries during the construction process, we were not given any more information concerning the $500.00 certificate. In December 2000, we were finally told by NorthStar that we need to go into the Total Gas Station and fill out a form which would in turn be confirmed by NorthStar. We filled out the form. We were then told by Barbara Robbins that "she had a problem with the form". She did not feel that there was adequate evidence that we had come into their office because of the offer. She stated that "they (NorthStar) already owed you a lot of money" and that she was not inclined to believe our story. At this point I refused to get into a prolonged discussion concerning our claim. I could see she was intent upon reneging on her offer and I saw no purpose in pursuing the matter with her.

There was nothing on the sign, or in any advertising, or your statement, that indicated a buyer had to jump thru certain hoops in order to get the offer certificate. The sign basically said, "Buy a house from NorthStar, get $500.00 certificate for Total". I've talked to several others who have also been denied their certificates.

We are writing you this letter to make you aware that NorthStar, specifically Barbara Robbins and Doug Robbins, appear to be cheating you out of income because they are refusing to honor their advertised incentives. You may want to take this into consideration should you anticipate any future dealing with them.
